Terms of Service
These Terms of Service (“Terms”) govern access to and use of the Platform, including its website, applications, interactive maps, destination information, subscription features and associated services (collectively referred to as the “Service”). By accessing, registering for or using the Service, you acknowledge that you have read, understood and agreed to be bound by these Terms and the Privacy Policy. If you do not agree to these Terms, you must refrain from accessing or using the Service. The Platform reserves the right to modify, suspend or discontinue any aspect of the Service, subject to applicable laws and regulations.
Nature and Purpose of the Service
The Service is a digital platform designed to facilitate the discovery, exploration and organisation of off-road destinations and outdoor recreational locations. The Service may provide interactive maps, geographical coordinates, destination descriptions, terrain information, difficulty classifications, route information and personal destination management features. All information is provided for general informational and recreational purposes only. The Service does not constitute professional navigation advice, a certified route guidance system, an organised expedition service, a safety assessment service or an emergency assistance facility. The inclusion of any destination, route or location does not constitute a recommendation, certification or guarantee of its safety, suitability, accessibility or legality.
Eligibility and Account Registration
Users must possess the legal capacity to enter into binding agreements under applicable law. Access to certain features may require registration and the creation of a personal account. Users agree to provide accurate and up-to-date information and to maintain the confidentiality of their account credentials. Users are responsible for activities undertaken through their accounts, except where otherwise provided by applicable law. Accounts are intended for personal use and may not be transferred, sold or shared in a manner that circumvents subscription restrictions. The Platform reserves the right to restrict, suspend or terminate accounts where users breach these Terms, engage in fraudulent activities or misuse the Service, subject to applicable law.
Acknowledgement and Assumption of Risk
Off-road driving, desert exploration and outdoor recreational activities are inherently hazardous and may result in serious injury, permanent disability, death, property damage or financial loss. Potential hazards include, without limitation:
- Unstable terrain, shifting sand, steep gradients and concealed obstacles.
- Extreme temperatures, adverse weather and sudden environmental changes.
- Vehicle breakdowns, mechanical failures and immobilisation.
- Becoming lost, stranded or isolated in remote areas.
- Inadequate mobile network coverage, unreliable GPS reception and communication failures.
- Delayed or unavailable emergency and recovery assistance.
- Encounters with wildlife and other natural hazards.
By using the Service in connection with such activities, users acknowledge the existence of these risks and accept responsibility for their decisions and participation. Users are responsible for assessing their experience, physical capabilities, vehicle suitability, equipment and prevailing conditions before undertaking any activity. The Platform does not guarantee that any destination, route or activity is safe or appropriate for any particular user. Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded or restricted.
Accuracy of Maps and Destination Information
The Platform endeavours to provide accurate and useful geographical information. However, the accuracy, completeness, reliability and currency of such information cannot be guaranteed. Destination descriptions, geographical coordinates, route alignments, boundaries and other mapping information may contain inaccuracies, omissions or outdated details. Users acknowledge that:
- Coordinates may not identify a precise or safe access point.
- Routes and trails may change, deteriorate, become obstructed or cease to exist.
- Destination boundaries and mapped geographical features may be approximate.
- Environmental conditions and terrain characteristics may change without notice.
- Information concerning accessibility, difficulty, risk, surface conditions and network coverage may be estimated or outdated.
- Mapping technologies and third-party geographical data may be subject to technical errors or limitations.
Users must independently verify relevant information and exercise appropriate judgement before travelling to any destination. The Service must not be relied upon as the sole means of navigation or as a definitive source of safety information.
Destination Classifications and Assessments
The Service may display difficulty ratings, risk classifications, terrain characteristics, accessibility indicators, network coverage estimates and other descriptive assessments. Such classifications are indicative only and may be derived from estimates, available geographical information, observations or subjective evaluations. They do not constitute professional assessments, official certifications or guarantees of actual conditions. A destination classified as easy, accessible or low risk may nevertheless present significant hazards. Users remain responsible for independently evaluating the suitability of any destination in light of their experience, equipment, vehicle capabilities and prevailing conditions.
Access Restrictions and Legal Compliance
The appearance of a destination, route or geographical area within the Service does not establish or imply a legal right of access. Locations may be situated on private property, within protected environmental areas, military installations, government-controlled land or other restricted territories. Users are responsible for complying with all applicable laws, regulations, restrictions and official instructions, including requirements relating to:
- Private property and land ownership.
- Protected areas and environmental conservation.
- Military, governmental and security restrictions.
- Permits, approvals and access authorisations.
- Road traffic and off-road vehicle regulations.
The Platform does not authorise trespassing, unlawful entry or activities prohibited by the relevant authorities. Users must independently establish whether access to a particular location is lawful and permitted.
Environmental Protection and Responsible Conduct
Users are expected to conduct their activities responsibly and with due regard for the natural environment, wildlife, local communities and protected landscapes. The Service must not be used to facilitate unlawful environmental damage, destruction of vegetation, disturbance of wildlife, littering or unauthorised access to protected areas. Users are responsible for observing applicable environmental regulations and restrictions governing vehicle access and recreational activities. The Platform encourages responsible exploration and the preservation of natural environments for future generations.
Vehicle Suitability and Personal Preparedness
Users are solely responsible for ensuring that their vehicles are appropriately maintained, equipped and suitable for the intended terrain and activities. Users should undertake appropriate preparations, including consideration of:
- Vehicle condition, capabilities and mechanical reliability.
- Fuel, water and essential supplies.
- Recovery equipment and emergency provisions.
- Weather forecasts and environmental conditions.
- Communication arrangements and alternative navigation methods.
- Personal experience and the availability of suitable assistance.
Users should refrain from undertaking activities that exceed their capabilities or the limitations of their vehicles. The Platform does not inspect vehicles, verify driving qualifications or supervise off-road activities.
GPS, Navigation and Connectivity
The Service may rely upon satellite positioning systems, device location services, mobile networks and third-party mapping technologies. The accuracy and availability of these systems may be affected by environmental conditions, signal interference, device limitations, network interruptions and other circumstances beyond the Platform’s control. Location information may be inaccurate, delayed or unavailable. Users must exercise independent judgement and maintain appropriate alternative navigation arrangements, particularly when travelling in remote or hazardous environments. The Service must not be operated in a manner that distracts users from driving safely or contravenes applicable road traffic regulations.
Emergency Assistance
The Service is not an emergency response, rescue, monitoring or vehicle recovery service. The Platform does not guarantee the availability of emergency communications, rescue personnel, recovery services or medical assistance at any destination. Users are responsible for making suitable emergency arrangements and contacting the appropriate authorities or emergency services when assistance is required. The Platform does not control the availability, response times or performance of independent emergency or recovery providers.
Subscriptions, Payments and Renewals
Certain features and destination information may be accessible only through a paid subscription. Subscription prices, billing periods, included features and applicable charges are disclosed during the subscription process. By purchasing a subscription, users authorise the applicable payment processor to collect the charges disclosed at the time of purchase. Where automatic renewal applies, subscriptions renew at the end of the relevant billing period unless cancelled before the renewal date. Users may manage or cancel subscriptions through the account settings provided within the Service. Unless otherwise specified at the time of purchase, cancellation prevents subsequent renewals but does not immediately terminate access for the remainder of an existing paid subscription period. Refunds, cancellation rights and other consumer remedies remain subject to applicable laws and the terms disclosed during purchase. The Platform may revise subscription prices or features, subject to applicable notification requirements and consumer protection legislation. A subscription provides access to designated Service features and does not guarantee the continued availability of any particular destination, route or item of content.
User Content and Personal Information
The Service may enable users to save destinations, create personal lists, record completed visits, maintain notes and organise information associated with their accounts. Users are responsible for ensuring that information they submit is lawful, accurate and does not infringe the rights of third parties. Users retain ownership of original content they create. By submitting content, users grant the Platform a limited, non-exclusive licence to store, process, reproduce and display such content solely as reasonably necessary to operate and provide the Service. The Platform may remove content that breaches these Terms or applicable law. The continued availability of user-generated information cannot be guaranteed, and users are encouraged to maintain independent copies of important records.
Intellectual Property Rights
The Service, including its software, interface designs, original destination descriptions, databases, graphics, visual elements and proprietary materials, is protected by applicable intellectual property legislation. Except where expressly authorised or permitted by law, users must not reproduce, distribute, modify, commercially exploit, systematically extract or redistribute protected content. Users must not employ automated scraping, data harvesting or similar methods to reproduce substantial portions of the Service or its destination database without authorisation. Access to the Service grants users a limited, personal, non-exclusive, non-transferable and revocable licence to use its features in accordance with these Terms. Subscription payments do not confer ownership of any intellectual property. Third-party mapping data, geographical information and associated materials remain subject to the rights and licensing conditions of their respective owners.
Acceptable Use
Users must not:
- Use the Service for unlawful, fraudulent or harmful purposes.
- Attempt to gain unauthorised access to accounts, systems or restricted information.
- Interfere with the security, integrity or operation of the Service.
- Circumvent subscription restrictions, authentication mechanisms or access controls.
- Reproduce or commercially exploit protected content without authorisation.
- Introduce malicious software or engage in activities intended to disrupt the Service.
- Misrepresent destination information as official authorisation, safety certification or professional guidance.
- Use the Service to facilitate trespassing, environmental damage or other unlawful activities.
The Platform may take proportionate measures against violations, including restricting access or suspending accounts, subject to applicable law.
Third-Party Services
The Service may incorporate third-party mapping technologies, authentication providers, payment processors and other external systems. These services may be governed by their own terms, policies and technical requirements. The Platform does not control the independent operation, availability, accuracy or security of third-party services. Changes, interruptions or failures affecting third-party services may influence the functionality or availability of the Service. Nothing in these Terms restricts rights or remedies that cannot lawfully be excluded.
Service Availability and Modifications
The Platform may update, modify, improve, suspend or discontinue features where reasonably necessary for operational, technical, security or legal purposes. Continuous, uninterrupted or error-free availability of the Service is not guaranteed. Temporary interruptions may occur due to maintenance, infrastructure failures, technical difficulties or circumstances beyond reasonable control. Material modifications affecting paid subscriptions will be handled in accordance with applicable consumer protection requirements.
Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. The Platform makes no guarantee that maps, destinations, routes, classifications, geographical information or associated content will be accurate, complete, current, accessible or suitable for any particular purpose. The Platform does not warrant that the Service will operate continuously or without technical errors. Nothing in these Terms excludes statutory warranties, guarantees or protections that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, the Platform shall not be liable for losses, injuries or damages arising from users’ independent decisions to undertake off-road activities, including those resulting from hazardous terrain, adverse weather, inadequate preparation, vehicle failure or unlawful access to restricted locations, except where liability cannot lawfully be excluded. The Platform shall not be liable for indirect, incidental or consequential losses arising from use of the Service to the extent that such exclusions are legally permissible. Users acknowledge that geographical information, destination descriptions and safety classifications cannot eliminate the risks associated with outdoor activities. Nothing in these Terms excludes or limits liability for fraud, wilful misconduct or any other matter for which liability cannot lawfully be excluded or restricted.
Indemnification
To the extent permitted by applicable law, users agree to indemnify the Platform against reasonable third-party claims, liabilities, losses and expenses arising from unlawful use of the Service, infringement of third-party rights or material breaches of these Terms. This obligation shall not apply to the extent that a claim arises from the Platform’s own unlawful conduct or circumstances in which liability cannot legally be transferred.
Privacy and Data Protection
The Platform processes personal information in accordance with its Privacy Policy and applicable data protection legislation. Such information may include account details, authentication records, saved destinations, user preferences, location information and activity records. The collection, processing, retention, disclosure and protection of personal information are governed by the Privacy Policy. Users may exercise their applicable data protection rights through the procedures made available within the Service.
Account Suspension and Termination
Users may discontinue use of the Service and request account deletion through the available account management procedures. The Platform may restrict, suspend or terminate access where reasonably necessary to address breaches of these Terms, unlawful conduct, security threats or misuse of the Service. Termination may result in the loss of access to subscription features, saved destinations and account-related information, subject to applicable legal obligations and consumer rights. Termination does not affect rights or obligations accrued before the date of termination.
Amendments to These Terms
The Platform may revise these Terms to reflect changes in its operations, features, security requirements or applicable legislation. The current version will be made available through the Service, together with the date of its most recent revision. Where required by law, users will receive appropriate notice of material amendments and an opportunity to review or accept them. Continued use following the effective date of lawfully implemented amendments constitutes acceptance where permitted by applicable law.
Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the applicable laws of the United Arab Emirates. Any dispute arising from or relating to these Terms or the Service shall be subject to the jurisdiction of the competent courts of the United Arab Emirates, without prejudice to mandatory consumer protection provisions or jurisdictional rights that cannot lawfully be excluded.
Severability
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision shall be limited or severed to the extent necessary. The remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy and any additional policies expressly incorporated by reference, constitute the agreement governing use of the Service. Failure by the Platform to enforce any provision shall not constitute a waiver of its right to enforce that provision subsequently.
